Injunctions – Chaban Law Group.


An injunction is a court order prohibiting an individual from undertaking certain acts. Florida law provides for an injunction against an individual for numerous reasons, namely however, domestic violence, dating violence, sexual violence, repeat violence and stalking.

Domestic Violence – These types of injunctions are provided to individuals that have either been threatened or where there has been some kind of act of violence towards blood relatives, family members, roommates, significant others, and spouses.

Dating Violence – This type of injunction can be filed if the parties have, or have had, a continuing and significant relationship of a romantic or significant nature. A victim of dating violence who has reasonable belief that he or she is in imminent danger of becoming the victim of another act of dating violence, may obtain a dating violence injunction.

Sexual Violence – This type of injunction can be filed if you have been the victim of any sexual act done using force against the victim’s will or against a victim who is unable to comprehend the nature of the act. Sexual violence means any one incident of:

• sexual battery, as defined in Chapter 794, Florida Statutes;
• a lewd or lascivious act, as defined in Chapter 800, Florida Statutes, committed upon or in the presence of a person younger than 16 years of age;
• luring or enticing a child, as described in Chapter 787, Florida Statutes;
• sexual performance by a child, as described in Chapter 827, Florida Statutes; or
• any other forcible felony wherein a sexual act is committed or attempted

Repeat Violence – This type of injunction is used when there has been two incidents of violence that have been committed against you or a member of your immediate family by another individual. It is required that one of these incidents have occurred within 6 months of filing this kind of petition.

Stalking – A family or household member who is either the victim of domestic violence or has reasonable cause to believe he or she is in imminent danger of becoming the victim of domestic violence may petition for a domestic violence injunction. Each type of injunction has a specific set of requirements that must be met before a judge will issue an injunction.
